Day 1 CPT to STEM OPT Trajectories: Maintaining Compliance in AI R&D Roles
Understanding the scrutiny around Day 1 CPT programs and how to evaluate continuity risk for AI research hires.
Curricular Practical Training lets F-1 students work when the employment is an integral part of their curriculum. Some graduate programs authorize CPT from the first day of enrollment. These 'Day 1 CPT' programs are legitimate when the work is genuinely curricular, but they receive heightened attention during later benefit requests, so AI employers should understand the trajectory before onboarding.
Why the trajectory matters
A candidate may move from Day 1 CPT to OPT from a subsequent degree, then to a STEM OPT extension, then into an H-1B petition. Each step is evaluated independently, but adjudicators may review prior history. Evidence that the CPT was integral to coursework, that the student attended classes and maintained status, protects later filings.
Due diligence checklist for AI R&D managers
- Confirm the CPT authorization on the I-20 lists your company, dates and part-time or full-time designation.
- Verify the program is accredited and the role relates to the course of study.
- Keep documentation of how the research work connects to academic requirements.
- Plan the transition date to OPT or STEM OPT well before CPT ends to avoid gaps.
Structuring research roles defensibly
R&D roles — training new architectures, building evaluation benchmarks, publishing internal research — align naturally with graduate curricula. Document projects with clear academic linkage: research memos, supervised milestones and deliverables that a faculty advisor could recognize.

Governance for continuity
Maintain a confidential, access-controlled tracker owned by HR and counsel — not by engineering managers — so status data is handled under appropriate privacy controls while still triggering the right operational actions.
