H-1B Specialty Occupation Petitions for Generative AI and LLM Architects

Articulating why LLM architecture roles require specialized degrees — and avoiding vague job descriptions.

An H-1B petition must show that the position is a specialty occupation: one requiring theoretical and practical application of a body of highly specialized knowledge and at least a bachelor's degree in a specific specialty or its equivalent. Generative AI roles are highly technical, but petitions are still denied when job descriptions read like marketing copy.

Describe the work, not the buzzwords

Replace 'leverage cutting-edge AI' with concrete duties and the percentage of time spent on each. Adjudicators look for evidence that the duties demand advanced coursework in areas like linear algebra, probability, optimization and distributed systems.

Example duty breakdown

  • 30% — Design transformer fine-tuning strategies (LoRA, QLoRA, full-parameter) and select hyperparameters based on loss-landscape analysis.
  • 25% — Architect retrieval-augmented generation pipelines including embedding model selection and vector index design.
  • 20% — Build evaluation frameworks measuring faithfulness, toxicity and calibration.
  • 15% — Optimize inference via quantization, KV-cache management and continuous batching.
  • 10% — Author technical design documents and review peer architectures.

Connecting degree to duties

Map each duty to specific degree fields — computer science, electrical engineering, mathematics, statistics. A table in the support letter that links duties to coursework (e.g., 'Numerical optimization → gradient-based fine-tuning') helps demonstrate a direct relationship.

| Duty | Required knowledge | Degree field |
|------------------------------|----------------------------|---------------|
| Fine-tuning strategy design | Convex & stochastic optim. | CS / Math |
| RAG index architecture | Information retrieval | CS |
| Calibration evaluation | Probability & statistics | Statistics |

Consistency across filings

The SOC code chosen on the Labor Condition Application, the job posting, the offer letter and the petition should describe the same role. Inconsistencies between an internal posting and the petition are a frequent trigger for Requests for Evidence.
