Technical Compliance
Navigating STEM OPT Extensions for Enterprise AI and Machine Learning Engineers
How AI teams can structure roles, training plans and supervision to support a compliant 24-month STEM OPT extension.
Many of the strongest machine learning engineers entering industry hold F-1 status and rely on Optional Practical Training. For graduates of qualifying STEM degrees, the 24-month STEM OPT extension is the bridge between graduation and longer-term work authorization. For an enterprise AI organization, supporting that extension is less about paperwork and more about designing a genuine, structured training relationship.
Eligibility foundations
The employee must hold a degree whose CIP code appears on the DHS STEM Designated Degree Program List, and the employer must be enrolled in E-Verify and in good standing. The role must be directly related to the degree. For computer science, statistics, data science or electrical engineering graduates, ML engineering roles usually map cleanly — but the connection must be articulated, not assumed.
The Form I-983 as an engineering artifact
Form I-983 is the training plan that the employer and student sign. Treat it like a design document. Specific learning objectives tied to real systems — for example, owning the evaluation harness for a retrieval pipeline, or migrating serving from TorchServe to Triton — are far more defensible than generic phrases like 'develop AI skills'.
Writing measurable objectives
- Name the technology and the outcome: 'Reduce p95 inference latency of the ranking model by 30% using TensorRT optimization.'
- Describe supervision: who reviews work, how often, and through what mechanism (design reviews, code review, 1:1s).
- Define evaluation: quarterly written self-evaluation and the 12-month evaluation signed by the supervisor.
Operational controls for hiring managers
Material changes — a new manager, a different team, a substantial change in duties or reduced hours — generally require an updated I-983 submitted to the DSO. Build a lightweight HR workflow that flags these events automatically whenever an STEM OPT employee is moved in your HRIS.
on employee.update(e):
if e.status == 'STEM_OPT' and (
e.manager_changed or e.role_changed or e.hours < 20):
open_ticket('Update I-983 and notify DSO', owner=e.supervisor)Reporting cadence
Students must validate reporting obligations every six months and report changes within ten days. Employers must report termination or departure to the DSO within five business days. Automating reminders removes the most common source of inadvertent violations.
